By creating an account on the Menumize platform or by using any of our services, you agree to be bound by these Terms of Service and all policies incorporated by reference, including our Privacy Policy and Cookie Policy.

These Terms constitute a legally binding agreement between you — the venue operator or authorised user — and Naya Farms (نايا للأعلاف والدواجن), trading as Menumize, a sole proprietorship registered in Lebanon (Commercial Register No. C.O8097, Baabda Court). If you do not agree to these Terms, you must not use the platform.

We may update these Terms from time to time. We will notify you of material changes by email to the address on your account. Continued use of the platform after the effective date of any update constitutes your acceptance of the revised Terms.

To use the Menumize platform, you must register an account with accurate, current, and complete information. You agree to keep this information up to date for the duration of your subscription.

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify us immediately at info@menumize.com if you become aware of any unauthorised access to or use of your account.

Accounts are for business use by venue operators in the food and beverage industry. You may invite staff members to collaborate on your account, subject to the seat limits of your chosen subscription tier.

Menumize offers subscription plans billed monthly or annually. All new accounts begin with a 14-day trial period at no cost, with no credit card required. After the trial period, you must subscribe to a paid plan to continue accessing paid features.

Billing is processed by Paddle, our authorised reseller and Merchant of Record. By subscribing, you agree to Paddle's Buyer Terms in addition to these Terms. Your subscription renews automatically at the end of each billing period unless you cancel before the renewal date.

You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of the current billing period; you retain full access until that date. We do not offer prorated refunds for unused portions of a subscription period, except where required by applicable law.

We reserve the right to modify subscription pricing with at least 30 days' written notice. Your continued use of the platform after the effective date of a price change constitutes your acceptance of the new pricing.

You agree to use Menumize only for lawful purposes and in accordance with these Terms. You must not:

• Send unsolicited commercial messages or spam to restaurant guests via any channel enabled by the platform
• Collect or store guest personal data without a lawful basis and appropriate consent under applicable law
• Attempt to gain unauthorised access to any part of the platform, its infrastructure, or other users' accounts
• Use the platform to infringe the intellectual property rights of any party
• Engage in any conduct that disrupts, degrades, or interferes with the availability or performance of the platform
• Resell, sublicense, or otherwise commercialise access to the platform without our prior written permission
• Use the platform in any jurisdiction where its use is prohibited by applicable law

WhatsApp messaging features must be used in compliance with Meta's WhatsApp Business Policy. You are solely responsible for obtaining valid, documented guest consent before sending WhatsApp messages through the platform.

Your content: You retain full ownership of all content you create using Menumize, including menu items, descriptions, images, and guest data. You grant Menumize a limited, non-exclusive licence to host, store, and process this content solely to provide and operate the platform services.

Guest data: Guest data captured through your Menumize account belongs to you as the venue operator. Menumize processes this data as your data processor in accordance with our Data Processing Addendum. You are responsible for ensuring you have a lawful basis for collecting and processing guest data, and for providing guests with appropriate notice and rights of access.

Menumize intellectual property: The Menumize platform — including all software, user interface design, brand assets, and documentation — is the intellectual property of Naya Farms. These Terms do not grant you any ownership rights in our intellectual property beyond the limited licence to use the platform as described herein.

You may terminate your account at any time by cancelling your subscription in account settings and submitting a deletion request to info@menumize.com.

We may suspend or terminate your access to the platform immediately and without prior notice if we determine that you have materially violated these Terms, that your use poses a security or legal risk to the platform or other users, or that continued provision of services is prohibited by applicable law.

Upon termination, your right to access the platform ceases immediately. We will retain your account data for 90 days following termination to allow for data export requests, after which it will be permanently deleted. Contact info@menumize.com to request a data export within this window.

The Menumize platform is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that the platform will be uninterrupted, error-free, completely secure, or free from bugs or viruses. We do not warrant the accuracy, completeness, or reliability of any analytics, guest segments, or AI-generated content produced by the platform. Business decisions made on the basis of platform outputs remain your sole responsibility.

Some jurisdictions do not permit the exclusion of implied warranties. In such jurisdictions, the above exclusions apply only to the fullest extent permitted by applicable law.

To the fullest extent permitted by applicable law, Naya Farms (trading as Menumize) shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of, or inability to use, the platform — including but not limited to loss of revenue, loss of data, loss of goodwill, or business interruption — even if we have been advised of the possibility of such damages.

Our total aggregate liability to you for all claims arising from or relating to these Terms or your use of the platform shall not exceed the total fees paid by you to Menumize in the three calendar months immediately preceding the event giving rise to the claim.

Nothing in these Terms excludes or limits liability for fraud, wilful misconduct, death or personal injury caused by our negligence, or any other liability that cannot lawfully be excluded or limited.

These Terms are governed by and construed in accordance with the laws of the Republic of Lebanon, without regard to its conflict of law provisions.

Any dispute arising from or relating to these Terms that cannot be resolved through good-faith negotiation shall be subject to the exclusive jurisdiction of the competent courts of Baabda, Lebanon. Both parties submit to the personal jurisdiction of those courts for this purpose.

Notwithstanding the foregoing, Menumize reserves the right to seek injunctive or other equitable relief in any competent court to protect its intellectual property rights or to prevent irreparable harm.

Menumize is owned and managed by Naya Farms (نايا للأعلاف والدواجن), a sole proprietorship registered in Lebanon under Commercial Register No. C.O8097, Baabda Court, Ministry of Justice.
